General Information

Individuals covered by state social insurance

State social insurance in Lithuania is regulated by the Law on State Social Insurance of the Republic of Lithuania (Official Gazette, 1991, No. 17-447; 2004, No. 171-6295); the Law on Structure of the State Social Insurance Fund Budget of the Republic of Lithuania (Official Gazette, 2001, No. 91-3190); Law on Social Insurance of Occupational Accidents and Occupational Diseases of the Republic of Lithuania (Official Gazette, 1999, No. 110-3207; 2003, No. 114-5114); the Law on Sickness and Maternity Social Insurance of the Republic of Lithuania (Official Gazette, 2000, No. 111-3574); the Law on State Social Insurance Pensions of the Republic of Lithuania (Official Gazette, 1994, No. 59-1153; 2005, No. 71-2555), as well as by other laws of the Republic of Lithuania.

The Law on State Social Insurance of the Republic of Lithuania sets out the categories of individuals covered by state social insurance on a compulsory basis.

Individuals covered by state social insurance on a compulsory basis:

1. Individuals covered by all types of state social insurance on a compulsory basis:

1) persons employed on the basis of employment contracts; notary candidates (assessors); persons receiving remuneration for work and holding elected posts in elected organizations on the basis of membership as well as persons appointed to constituency, town, region and polling district electoral and referendum commissions; persons who are related to the insurer by employment or corresponding relations, as defined in the Law on Income Tax of Individuals, at the same time receiving income from this insurer for sports or performing activities; also the persons listed in this clause – permanent residents of Lithuania, as defined in the Law on Income Tax of Individuals, receiving income under author's agreements from the insurer – a Lithuanian entity, as this term is defined in the Law on Income Tax of Individuals;

2) state politicians, judges, state officials and civil servants indicated in the Law on the Remuneration of State Politicians, Judges and State Officials and the Law on Civil Service (with the exception of the civil servants indicated in paragraph 2), persons indicated in the Law on Delegation of Persons to International and European Union or Foreign States' Institutions receiving remuneration for work from a delegating institution of the Republic of Lithuania which pays social insurance contributions; persons receiving remuneration for work and appointed by the Seimas, the Speaker of the Seimas, the President of the Republic or the Prime Minister.

2. Individuals covered by pension and unemployment state social insurance on a compulsory basis:

  • officers of the system of the internal service, the system of the State Security Department, the Special Investigation Service and the Prisons Department under the Ministry of Justice of the Republic of Lithuania, as well as the officials of the agencies and undertakings subordinate thereto;
  • servicemen in the professional military service of the system of national defense and the statutory servants in the civil national defense service at the Second Investigation Department under the Ministry of National Defense;
  • spouses of civil servants, servicemen in professional military service and delegated persons who have not attained the age of superannuation age and do not receive the income related to employment relations – during a period when they reside abroad together with the civil servant or delegated person, where the latter has been delegated, or the civil servant has been transferred to a post at a diplomatic mission, consular office of the Republic of Lithuania, mission of the Republic of Lithuania at an international organization, international or European Union institution, a foreign state's institution; was sent on a special mission, or when they reside together with a serviceman in professional military service, where the serviceman in professional military service has been assigned to fulfill military service at a diplomatic mission, consular office of the Republic of Lithuania, mission of the Republic of Lithuania at an international organization, a foreign state's or international military or defense institution. Spouses of delegated persons are covered only if the delegated person receives remuneration for work and social insurance contributions of it are payable by the delegating institution of the Republic of Lithuania. Spouse of the President of the Republic who has not attained the age of superannuation and does not have individual insured income – during the tenure of the President of the Republic;
  • servicemen fulfilling mandatory initial military service in the armed forces of the Republic of Lithuania and the persons performing alternative national defense service;
  • by a choice of a family one of the parents (adoptive parents) or a person which was appointed under the established procedure to be a child's foster-parent, raising a child up to three years old;
  • one of the parents (adoptive parents) (under superannuation) of a disabled person who has a regular care dependence, or a person which was appointed under the established procedure to be a guardian or custodian of this disabled person and attending at home the said disabled person. This provision is also applied to one of the parents, guardian or custodian attending at home an invalid of absolute disability which was acknowledged as such up to July 1, 2005.

3. Self-employed persons, excluding those engaged in individual activities under business licences, covered on a compulsory basis by pension social insurance for the principal and supplementary parts of their pension, sickness and maternity social insurance, when coverage provided an entitlement to receive only maternity, paternity and maternity (paternity) benefits.

4. Persons covered on a compulsory basis by pension social insurance to receive only the basic part of a pension shall include:

  • persons engaged in individual activities under a business licence;
  • clergymen of traditional and other religious communities and associations recognized by the State as well as the nuns and monks working only in a convent and monastery.

5. Permanent residents of the Republic of Lithuania, excluding those listed in Sub-paragraph 1, Paragraph 1, Article 4 of the Law on Income Tax of Individuals, receiving income under author's agreement from the insurer – a Lithuanian entity, shall be covered on a compulsory basis by pension social insurance for the principal and supplementary parts of their pension, sickness and maternity social insurance, as well as health insurance, except for cases when such income is sourced from engagement in individual activities. Permanent residents of Lithuania receiving income for sports or performing activities from the insurer, as these terms are defined in the Law on Income Tax of Individuals, with which they are not related by employment or corresponding relations, shall be covered on a compulsory basis by pension social insurance for the principal and supplementary parts of their pension, sickness and maternity social insurance, as well as health insurance, except for the cases when such income is sourced from engagement in individual activities.

6. Individuals covered on a compulsory basis only by social insurance of occupational accidents and occupational diseases shall include:

  • pupils of vocational schools, students of post-secondary and higher education institutions as well as the persons posted by local labour exchange offices for vocational training or vocational rehabilitation – during their vocational practice at an agency or undertaking;
  • persons receiving remuneration for work and placed in social and psychological rehabilitation institutions – during the period of their work;
  • persons sentenced to imprisonment and receiving remuneration for work – during the period of their work.

Persons covered by all types of state social insurance on a compulsory basis shall also be qualified to receive state social insurance sickness and maternity, paternity and maternity (paternity) allowances payable in compliance with the procedure established by the Law on Sickness and Maternity Social Insurance of the Republic of Lithuania (Official Gazette, 2000, No. 11-3574), also benefits provided for in the Law on State Social Insurance of Occupational Accidents and Occupational Diseases of the Republic of Lithuania, as well as state social insurance old-age, disability, survivor's and orphan's pensions in compliance with the procedure established in the Law on State Social Insurance Pensions (Official Gazette, 1994, No. 59-1153; 2005, No. 71-2555). The persons mentioned above shall also be eligible for the benefits provided for in the Law on Unemployment Social Insurance. Persons falling within this category shall be entitled to use health insurance services.

Persons covered by pension social insurance and unemployment social insurance on a compulsory basis shall be entitled to receive state social insurance old-age, disability or survivor's and orphan's pensions, as well as they shall be entitled to the benefit provided for in the Law on Unemployment Social Insurance.

Servicemen fulfilling mandatory initial military service in the armed forces of the Republic of Lithuania and persons fulfilling alternative national defense service, by a choice of a family one of the parents (adoptive parents) or a person who was appointed under the established procedure to be a child's foster-parent, raising a child up to three years old, one of the parents (adoptive parents) (under superannuation age) of a disabled person who has a regular care dependence, or a person who was appointed under the established procedure to be a guardian or custodian attending at home the said disabled person. (This provision is also applied to one of the parents, a guardian or custodian attending at home a person with total disability who was acknowledged as such up to July 1, 2005, shall be covered on a compulsory basis by state social pension and unemployment social insurance with the state funds.

Persons covered by state social insurance for the principal part of a pension

Persons engaged in individual activities by holding business licences shall be covered on a compulsory basis to receive the principal of their pension (the amount of contribution - 50 percent of the basic pension; currently the basic pension is LTL 360).

Business licence holders may not pay contributions (this period will not be included into the state social pension insurance record) only if they:

  • are recipients of their state social insurance old-age or social insurance work incapacity (disability) pensions awarded and (or) payable in accordance with the Law on State Social Insurance Pensions of the Republic of Lithuania;
  • are recipients of their social assistance pension or reimbursement excluding the social orphanage pension, awarded in accordance with the Law on State Social Assistance Benefits of the Republic of Lithuania;
  • are recipients of their (social insurance) old-age or work incapacity (disability) pension related to employment relations from any European Union member state or another state of the European Economic Area, Confederation of Switzerland, or the country with which Lithuania has signed an international treaty for application of social security aid;
  • are kept in places of imprisonment or where forced inpatient health observation measures or disciplinary measures in specialized mental health institutions have been imposed by respective court judgment in compliance with the procedure established by the Criminal Code;
  • are covered by social insurance on a compulsory basis according to the laws of the Republic of Lithuania;
  • have attained the age of superannuation in accordance with the Law on State Social Insurance Pensions.

Clergymen of traditional and other religious communities and associations recognized by the State, as well as the nuns and monks working only in a convent and monastery shall be covered for the principal part of a pension with the state funds.

From January 1, 2006, pupils of vocational schools, students of post-secondary and higher education institutions, as well as persons posted by local labour exchange offices for vocational training or vocational rehabilitation – during their vocational practice at an agency or undertaking shall be covered by insurance with the state funds by calculating social insurance contributions of occupational accidents and occupational diseases from the minimum monthly wage approved by the Government.

Local offices of the State Social Insurance Fund Board shall grant a social insurance number to persons covered by state social insurance on a compulsory basis and shall issue state social insurance certificates to the insured.

The procedure of issuing state social insurance certificates is regulated by the rules on granting a personal social insurance number, issuing and replacement of a state social insurance certificate approved by Order No. V-65 of the Director of the State Social Insurance Fund Board as of January 31, 2008 (Official Gazette, 2008, No. 17-627).

The tariffs of state social insurance contributions for the year 2010 were fixed in the Law on Approving the Indices of the State Social Insurance Fund Budget (Official Gazette, 2009, No. 151-6783)
